Terms of Service
Welcome to Achoo. These Terms of Service ("Terms") govern your use of the Achoo iOS application and the achooapp.co.uk website (collectively, the "Service").
By downloading or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Achoo iOS application ("App") operated by Yara Labs Ltd, a company registered in England and Wales ("we", "us", or "our").
By downloading, installing, or using Achoo, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of the App after any changes constitutes acceptance of the updated Terms.
2. Description of Service
Achoo is a hay fever companion app that provides:
- Daily pollen forecasts based on your location
- Personalised health recommendations based on your pollen sensitivities
- A symptom diary to track how you feel over time
- AI-generated insights and correlations (Achoo+ only)
- Push notifications with daily pollen briefs
Achoo is available as a free tier with basic features and as Achoo+, a premium subscription that unlocks the full feature set.
Achoo is an informational tool only. It is not a medical device, does not provide medical advice, and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional regarding any medical condition or treatment.
3. Eligibility
You must be at least 13 years of age to use Achoo (or 16 years of age in the European Union). By using the App, you represent and warrant that you meet this requirement.
4. Your Account
To use Achoo you must create an account using a valid email address and password. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately at support@achooapp.co.uk if you suspect unauthorised access to your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
5. Subscriptions and Payments
5.1 Free Tier
Achoo offers a free tier that provides access to daily pollen index data and basic tips at no charge. The free tier is provided at our discretion and may be modified or discontinued at any time with reasonable notice.
5.2 Achoo+ Subscription
Achoo+ is a premium subscription available on a monthly (£2.99/month) or annual (£19.99/year) basis. Achoo+ unlocks AI-generated daily briefs, 5-day pollen forecasts, the symptom diary, personal insights, Apple Watch complications, and home screen widgets.
5.3 Free Trial
If a free trial period is offered for the annual Achoo+ plan, your subscription will automatically begin at the end of the free trial period and you will be charged the applicable subscription fee unless you cancel before the trial ends.
5.4 Billing and Renewal
Subscriptions are billed through your Apple App Store account. Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your Apple ID account settings.
5.5 Price Changes
We may change subscription prices at any time with reasonable advance notice. Continued use of Achoo+ after a price change constitutes your acceptance of the new price.
5.6 Refunds
All purchases are processed through the Apple App Store. Refund requests are subject to Apple's refund policy. To request a refund, please visit reportaproblem.apple.com.
5.7 Subscription Management
Your subscription is managed by RevenueCat on our behalf and processed through the Apple App Store. We do not store your payment card details.
6. Acceptable Use
You agree to use Achoo only for lawful purposes and in accordance with these Terms. You must not:
- Use the App in any way that violates applicable local, national, or international laws or regulations
- Attempt to gain unauthorised access to any part of the App or its related systems
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Use automated tools, bots, or scrapers to access the App or its data
- Transmit any data that is harmful, offensive, or otherwise objectionable
- Interfere with or disrupt the integrity or performance of the App or its servers
- Use the App to develop a competing product or service
- Remove, alter, or obscure any proprietary notices or labels on the App
7. Health Information Disclaimer
Achoo provides pollen data and health recommendations for informational purposes only. The information provided by Achoo:
- Is not medical advice and does not constitute a doctor-patient relationship
- Should not be used to diagnose, treat, cure, or prevent any medical condition
- Is based on publicly available pollen data and general wellness information
- May not be accurate for your specific medical situation or sensitivities
AI-generated recommendations provided through Achoo+ are generated by Anthropic's Claude AI model. These recommendations are general in nature and are not tailored to your individual medical history or circumstances.
Always seek the advice of your doctor, allergist, or other qualified healthcare provider with any questions you may have regarding hay fever, allergies, or any other medical condition. Never disregard professional medical advice or delay seeking it because of something you have read in this App.
In a medical emergency, call 999 (UK) or your local emergency services immediately.
8. Pollen Data Accuracy
Pollen forecast data in Achoo is sourced from the Google Pollen API. While we strive to provide accurate and up-to-date information, we cannot guarantee the accuracy, completeness, or timeliness of pollen data. Actual pollen levels may vary due to local conditions, weather patterns, and other factors.
Pollen data is updated daily at approximately 05:00 UTC. Data may be unavailable or delayed in some regions or during periods of service disruption.
9. Intellectual Property
The App, including its design, logo, content, features, and functionality, is owned by Yara Labs Ltd and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial purposes in accordance with these Terms. This licence does not include the right to:
- Copy, modify, or distribute the App or its content
- Use the App for commercial purposes without our prior written consent
- Create derivative works based on the App
All rights not expressly granted in these Terms are reserved by Yara Labs Ltd.
10. User-Generated Content
You may submit content to Achoo, including symptom diary entries and notes ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a limited licence to store and process that content solely for the purpose of providing the App's features to you.
11. Third-Party Services
Achoo integrates with third-party services including Google Pollen API, Anthropic, Supabase, RevenueCat, and Apple. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices, availability, or content of any third-party services.
12. Service Availability
We aim to provide Achoo on a continuous basis but cannot guarantee uninterrupted availability. The App may be unavailable due to scheduled maintenance, unplanned outages, or circumstances beyond our reasonable control.
We reserve the right to modify, suspend, or discontinue the App or any part of it at any time with reasonable notice.
13. Limitation of Liability
To the fullest extent permitted by applicable law:
- Achoo is provided on an "as is" and "as available" basis without warranties of any kind
- We do not warrant that the App will be error-free, secure, or uninterrupted
- We expressly disclaim all implied warranties including merchantability and fitness for a particular purpose
Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total amount paid by you for Achoo+ in the 12 months preceding the claim, or £50, whichever is greater.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
14. Indemnification
You agree to indemnify and hold harmless Yara Labs Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
15. Termination
You may stop using Achoo and delete your account at any time through Settings → Delete my data. Deleting your account will permanently remove all your personal data from our systems.
We may suspend or terminate your access to Achoo at any time if we reasonably believe you have violated these Terms or for any other legitimate reason with reasonable notice where practicable.
16. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before bringing any formal legal proceedings, we encourage you to contact us at support@achooapp.co.uk to attempt to resolve any dispute informally.
If you are a consumer based in the EU, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
17. Consumer Rights
If you are a consumer in the UK or EU, you have statutory rights that cannot be excluded or limited by these Terms. Nothing in these Terms affects your statutory rights as a consumer, including rights under the Consumer Rights Act 2015 (UK) or applicable EU consumer protection legislation.
Under the Consumer Contracts Regulations 2013, you have a 14-day right to cancel a subscription from the date of purchase, unless you have already begun using the service. To exercise this right, contact us at support@achooapp.co.uk.
18. General Provisions
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yara Labs Ltd regarding your use of Achoo.
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
